As per yesterday’s floor summary (access link below), the House of Congress has been adjourned and this marks the end of the business activity in the house of the110th Congress. House will re-convene at 11:00 a.m. on January 3, 2009 and that will be the first session of the 111th Congress.

Well, you are missing the most important point - Illegal immigrant's probably don't care about the future of the country's educational direction. Family based immigrants don't care either. However WE are EB immigrants and we value education and that is exactly what we demonstrate by doing this. We should not be looking to fund hundreds of thousands of student's college education - heck even the mighty US government cannot do that. We are not a political organization. The way this will go out in the media is - these guys could have used the money to lobby with senators or other congressmen, instead, they choose to use it for a good cause. This is highly symbolic. And the key here is to involve the first lady. The moment you involve the first lady, it become apolitical.
Oh, and btw, we are not buying our way into a GC. Nowhere did I mention that. We, EB immigrants value education and hence want to donate for an educational charity/cause. We don't expect a GC by doing this - this is highly symbolic; however if the Obama administration takes up CIR this year and we start this campaign and this happens to go to the first lady and gain media attention at the right time, perhaps the administration would include legal immigration in the CIR which would have otherwise not been included.

If the hosung markets turned down like the NASDAQ 5 yrs ago, and brought down the whole economy with it, then as a result of the ensuing economic recession you lost one, two or all 3 of your jobs and ended up in negative equity, could not find a new job sponsoring H1b due to the deep recession and your greencard is nowhere in the near future. Would you still feel as secure and happy? I am not sure what country you are from, but would you make a salary close to what you are making here?
Security my friend, thats what a green card brings. I applaud you on your courage and bravery in just taking a chance and doing all these things, you will likely be fine and get your green card eventually but taking risks can bring consequences as well. Many people are more risk averse than you.
A GC is going to make finding a job a lot easier & is going to make you feel much more secure than a H1 is a fallacy in my opinion. I think, if you currently have a H1 job, you have proved your worthiness in the job market. In fact, you are probably better off than a GC holder, since you are forced to be on your toes to maintain and update your skill set for fear of the difficulty in finding another H1 job.
I have plenty of (EB) GC friends around me who got their GCs through their job through the 1996-2000 .com boom, but now have trouble finding their 1st right job, post the GC. They missed out on the 2002-2005 housing boom, all the time while I, on a H1 was reaping the fruits of taking the risk and getting in while still waiting out on my GC.
Besides, in a global economy US jobs themselves are far less secure than during any other times in modern day history, so even a US citizenship is not going to make one feel secure with regards to employment.
What is going to make you feel secure ultimately is being well qualified & well skilled. For people with the right qualifications and skills there will always be a H1 job (or for that matter a well paid job no matter what the geography) out there. In my opinion, having the right skills and qualifications is one's security, and that�s what I have always banked on while moving so forward on a H1.

I filed my I-485 on 2nd July 2007, My 180 days completes on 29th Dec 2007
I am in IT job, My job title is System Analyst and I want change the job with similar job title Sr System Analyst , But the technology(Oracle Stuff to Java Stuff) will be different then what is on labor certification.
My future employer will not file H1-B, So I have to start on EAD.
What should be process for me to do the same

* If yes, Can I do the AC21 with same or Different lawyer

Too many issues at that time. Old h1 was anyway expiring soon. Desi bodyshoper employer was going nuts sqeezing me dry. He was demanding money for everything from H1 extension to giving out compnay letters for GC related issues and thousands of such reasons. But as I already said.. it's done..it's done...
Your employer should pay for H1 and H1 extension. If he is exploiting you, and you accept being exploited, then you should also share the blame for accepting this.
This forum has past posts where people have shared information on how to complain against such employers. One of the goals of IV is to generate awareness in employees so that employees can use their voice against injustice.
Accepting such 'exploitation' should not be tolerated and you must take action against such an employer. It is such employers that give a bad name to the entire H1B visa program and the whole community is blamed and made to suffer. Our bills face an uphill task because of this. Employees must complain so that they can help fix the H1B and green card system.
I hope you use your voice and take action against such employer. IV is against such exploitation and it must be reported to DOL and USCIS. If you have to go to court for it, you should consider it.

you can go look at the o-net database online. you can specify keywords of your new job and it will present you different o-net codes. then look at the detailed description of each presented result and draw conclusions as to which one your job will fall under.

Not going to happen - whole point of not giving h1's their Social Security is to use to fund USs' dwindling Social Security funds. H1 is supposed to fund SS for the Baby boomers here. There is no way in hell we will get it before 10 years on H1.

BTW, can you call and ask if you case is preadjudicated. In our case my #@$@ lawyer refuses call USCIS or allow us to initiate an SR (one of the reasons why we had no idea that we were stuck in namecheck)

We cannot expect any movement because we have ~25k EB3's ready for approval with only 3-4k visas. Eb2's (I)could be in a slightly better situation by July '10 because of spillover from unused EB1's and EB2's. I am guessing that 12-15k EB 2's will benefit. The only sliver lining is that ROW's who had visa's available but were stuck due to processing delays will be relieved from the pain.
As per this everyone who got pre-adjudicated would be receiving their GC in FY2010. But, there are people from EB3I with PD as late as 2007 who got RFEs recently and got their cases pre-adjudicated( I am one of them even though my PD is March 2003 and when I called up NSC, they said my case was pre-adjudicated and waiting for a Visa number ).
With EB3I staying at 1 Nov 2001 when the new FY2010 quota starts in October doesnt match to what Ron Gotcher says.
Anyone have any opinion?

You never know! All the gray areas of payment, unenforceable contracts are a game of poker, he bluffed and you blinked. See if the reverse can happen now. Send him a mail or call him up and see his reaction. Say that you spoke to a lawyer and the recommended path is to begin with small-claims court and if that does not work out you will be filing a lawsuit. if he offers you anything back to avoid these hassles (say 3.5k) then go for it (& take your family out to hawaii this summer)
p.s: just as mbartosik said, you need documents to prove everything, hope you have all those, without that nothing will stand up in court (though you might scare him enough to actually pay you)

I hate to say it but this is starting to sound very much like an Alcoholics anonymous support group session. LOL.
Let me jump right in!
Get a grip guys. Life is not so bad. What you guys are worrying about is relatively trivial. The odds are heavily stacked in your favor for you to get the green card eventually, most likely within 2 yrs. I can't fathom another 2 plus years with no legislative relief. In the mean time as long as you stick to AC21 rules, you should have the courage to move jobs. Heck, with EAD, you could even move into something part time and try it out before finally deciding to commit etc. My point is you have tremendous flexibility, enjoy that.
In the small chance things do not work out, then you have presumably had an opportunity to save enough to purchase a decent home in India(or wherever your home country may be), a car and your line of work(I'm referring to the predominantly IT folks here) is in such international demand that you will be able to earn a livable wage anywhere, including India.
And here is the real shocker to many of you. There are millions of Americans(probably well over half) who will trade their position in life with you in a heart beat given the privilege, family and social support system, education, world view and demand you are in. Sometimes it is hard to see how blessed you actually are in this world. That is why I have taken a very grim view of people who have compared their issue to slavery etc. That only speaks to their unawareness of that practice.
Now I know none of this is going to get you your green card tomorrow and improve your mistreatment in this needlessly ridiculous and tortuous green card journey. However I am hoping it atleast gives you some perspective.

I am wondering everybody here is throwing stones at small consulting companies, I wonder how these people came to US surely somebody did there H1? right? People are working in big companies HP/Oracle/SAP bla bla.. but I'm sure they are not the ones who brought you guys here. Also the day they'll get their green cards each of these people are going to open similar companies and do the same thing. This is what I wrote. I just faxed last Tuesday and havent heard from either Congressman or Senator. To this letter I also attached a copy of my I 140 approval (shows PD), a copy of I 485 receipt notice and 2 service requests that were started for me.
Congressman XYZ,
Subject: Request for assistance with delayed Immigration Petition
Dear Sir,
I would like to request your assistance with a pending petition with USCIS that has seen an undue delay in processing. This I 485 petition (Application to Adjust to Permanent Resident Status) and has been pending at the Texas Service Center since it was received. The receipt date is June 15, 2007 which is prior to what is currently listed as the processing date on the USCIS website (current processing date listed as of September 30, 2008 is June 27, 2007. USCIS has not updated the processing dates after September 30, 2008 on their website).
My Priority date of August 9th, 2001 is current for my case category EB3 India. I have requested a status update from the USCIS service center and 2 service requests were started on my behalf but I have not heard anything or seen any progress on my case.
I would appreciate any assistance in speeding the processing of this petition. I am enclosing relevant receipts and letters. Please let me know if you need any further information.

My manager surprised me today saying that I was promoted yesterday from a programmer analyst to a systems analyst. I have an approved i-140 and have filed my 485. My priority date for EB3 is current. I also have a 3 year extension of H1B.
There is no change in the job responsibilities.
Question:
1. How soon should I file my AC21 request?
2. What is the impact of this promotion on my H1B?
3. I have waited for 7 years and I may be close to getting my Green Card. How does the AC 21 impact my pending 485?
I declined my promotion. My manager said that it would take a lot of effort to unwind this promotion. He was not pleased with my request.
Any ideas?
