You has incorrect infomation. Your Receive Date is a factor but PD is also a big factor, if limited number available.
If two person has submitted their application. One has PD 2001 and RD June 10 2007 and other had PD Jan 2006 with RD May 1 2006.
USCIS 485 Processing Date: June 15th 2007 and Visa Bullitin has "C"
Still PD with 2001 will get the the number first before PD 2006 case.
So
485 RD < USCIS 485 Processing date and PD < Visa Bulletin date
Order by PD desc

My labor was filed on July 2004 and I have not received an approval yet.
I got an RFE last week stating that Employeer has to again prove the RIR status of the application.
So Lawyer has started the advertisement process again.
One important issue is over looked here. Small employers will have a tough time in proving I-140 "ability to pay" for employees with older PD�s, whose labor got cleared after Aug 17 from BEC. Cuz the company has to prove its "ability to pay" the proffered wage starting from the date PD is established continuing until the adjudication of I-140.
Suppose the PD for an employee is Oct 2001 and the proffered wage is 80K per annum, then the company should prove that its assets, net income or salary payments were >=80K starting from Oct2001 continuing until the adjudication of I-140.
This is indeed an acid test for small employers.

how does one know NC is cleared? do you see an update?
No. Mine was cleared on July 22nd,08 - But did not see any LUDs.
If you had two different A#s (140 and 485) you will see an LUD on 140 when they reconcile the two.

I wanted to find about pre approved or pre adjudicated case, We have been hearing the same more often in the forum, so out of curiosity i opened a Service Request.
I kind of have a good relation ship with the former employer, worked with them for 4 years. I just called my company HR and he said he does not know my name is on withdrawn list but he will check the list and let me know tomorrow.

Also Mr O said out look for Eb2 india is grim and could have delay for decades .. where Eb3 india can be set to Oct 2001 in oct 2009. His whole prediction is based on current demand from USCIS.
Lets says he USCIS has 50k Eb2 india and 70k Eb3 india in back room. Have to give American consulates in India the credit that they have outsourced some job to external private companies.
At Indian consulate the story is quite different. There are many who share Pooja's feeling on this subject as being used to dealing with efficient private businesses in US, as soon as you enter the consulate, the sarkari inefficiency hits you like a ton of bricks. Every small screwup looks like a giant under our microscope and each further screwup just frustrates us exponentially.
As per my last visit to SF consulate, bracing for the worst, I got a surprise to find that it was a breeze, mostly because the lady at the counter was more compassionate and accommodating then the prior ones. But the failure is glaringly at the top level where they fail to define and refine the process, proof-read the information on website (list of document is vague and contains repetitions).
To summarize I think good workers can deliver some time, but the team will ultimately be a failure without good management at the top, and we all know the top management is sarkari babus who could care less as they were appointed from the sifarish of the Govt in New Delhi and not on their own merit.

Here are the some of the issues
1)Some credit unions will not open an account for your if you are not a citizen/green card holder
2)Same problem with Home loans some banks will not extend loans (I have personally faced these two issues)
3) With the realid act some stats are not giving driving license to non-immigrants that may have fixed but you still need to extend every year even if the state gives a license
4)You cannot get an homestead exemption(tax credit) if you buy a house
5)The latest tax stimulus package will not give tax credit to ITIN holders and with out immigrant status (or EAD) you cannot get an SSN.
As you all know we pay the taxes all kinds of taxes , help economy with our purchase power I can go on with the kind of positive things we bring to this country but for some reason we don't have any rights. I completely agree with the OP the crying baby gets the milk or cranky wheel gets the oil first. Every one if you don't fight for it we are not going get any thing. Remember the congress has write a letter to USCIS saying that the fee for N400 is increased but the service is not any better , why can't the same logic applied to green card applicants the fee is increased but we don't get any congress support isn't that something. Any way's that's my 2 cents....

Sanju just posted in the open what he wanted to say. He has some valid points you know; regarding how some people get fixated on the red dots. Would you have liked it better if he just gave you a red dot anonymously?
But please do not try to compare the dotting issue with the immigration issue.
If the immigration system is fixed, who cares a hoot about these dots? None of us would even be here if there was smooth legal immigration in this country.
Let the core work on the real issues.
And for the record, I personally do not like the dot system. I am in support of leaving all the comments in the open.
I also remember reading on this site some time ago that the dotting system came with the software used for these forums. And its not a simple flag that can be turned on/off to enable/disable that feature.

I agree with Munna Bhai on this. There is no need to put salt on the wound , we should help if we can on the issue in hand instead of judging others.
Were you witness to what happened in his home on that day?? If not, don't be judgemental....leave that to him and his wife and to family court. IV is not for "every good cause"...we are having very difficult time ourself...
Looks like you already received GC and you have great & lot of time to get into other issue.
