    Probably, nothing wrong to discriminate against h1b holders, but discrimination against citizens maybe taken seriously. As such, it is at company's discretion to hire u or not, internally, from what I learnt, if the company decides to hire u, they hire u, if not, they may give u this as a reason because they may have found someone with same skills but without requirement for sponser.
    If a company desperately needs u, they will do anything to hire u. If company thinks it must not have to deal with legal issues and overheads, it may not hire u, may keep u on hold.
    Basically, we are on our own, and we can only try and try. It is the land of opportunities, and there will be opportunities for everyone somewhere.

    I am not saying the announcement tomorrow is a bad thing. I am just not very excited

    Title VII and the other antidiscrimination laws prohibit discrimination against individuals employed in the United States, regardless of citizenship. However, relief may be limited if an individual does not have work authorization.

    As per legal definition, H-1B holders have work authorization. I am not sure of the extent of rights of H-1B holders, but people holding unrestricted EAD can definitely sue.

    The message says designated time frame, without specifying what the "designated time frame" is. I am just curious, where did you find that 120 days is the "designated time frame"?

    As of now, for the background/name check -time frame in FBI rule-book is 120 days. It will be great if uscis can approve AOS if nothing adverse is reported by FBI within 120 days

    Look at the number of people who posted messages to this thread .... even if you say 4 times that number of people posted messages to WhiteHouse.gov it is no where close to the numbers we need .... Lets not kid ourselves - Unless there is a miracle - most of us are looking at aleast another 3-4 year wait :(

    1. His salary CAN be raised.
    2. His wife CAN work, as article mentions that he applied for GC in 2004
    3. I never heard about 1 million - I guess we were talking about 140000 unused visas right? Where this 1 million came from?
    4. If the company is bought - one doesn't generally reapply for GC.

    Even little lies don't serve a good cause as this article can be easily discredited.

    I have also contacted a lwyer who is different from my company lawyer. She has offered to put my case forward to USCIS (not WOM) for $ 300. She said they have means of bringing the case to their attention if its fallen through the cracks.
    Do you think its worth trying ? my only copncern is she wants me to sign a new G28 and Im worried about issues with my existing case since I dont want to mess withh my company lawyer and I think I want to keep him as the attorney on file. Per this new lawyer thats not an issue and they will only be the attorney for inquiry purposes.
    Any feedback on if this is worth doing ?

    Note: These details may be true. Last month we had heard such information but not in detail and thus had not posted it. We were hoping to get this news within 6-8 weeks (As per oour note on http://immigrationvoice.org/forum/showthread.php?t=14749). There are efforts to make name checks current and that is good news for everyone waiting for several years in the namecheck blackhole. It will also help recent applicants who might be getting into this problem.

    Here is another part of story.

    My PD was current back in 2004, this attorney/employer ignored my calls/emails from Oct to Dec 15. They filed my 485 during christmas week end, they screwed up something and USCIS rejected my application (thats what they say). Thanks to retrogession from Jan 2005. All my documents were ready by Oct. I would have had my EAD since 2005.

    De javu, again I am being mandated to file thru same attorney. I don't have problem paying more money for a good attorney and good service.

    I don't know if I am in a trap or something.


    I think u r in a trap here. I recently talked to a HR of a desi company and he clearly told me his boss does not want to file for 485 for all eligible applicants and is working on strategies to fool his employees into prolonging things till dates retrogress.

    U can choose ur lawyer, u don't have to let employer know u applying for 485 at all. Do not link ur lawyer and employer for any reason. Keep them both away. U already have 140 approved and u have nothing to lose.

    Photos: $75
    Photocopy/Scan/Color Print : $50
    Fed Ex: $45
    Calls to India to get documentation: $30

    Total=$500+$75+ $45+ $30
    =$650

    I am now using this opportunity (retrogression) to get my 3 yr H1-B extension through premium processing. Who knows when they stop this again?

    I came through SFO a few days ago. I was prepared to leave if told that I could not stay, (having lost my job last November and not having found another). I was asked if I was still working for the petitioner, I replied truthfully that I was not and that I was looking for another job. I was then told it was OK, and "welcome back".

    I've got a code I biometric notice eventhough I did not apply for and EAD. What might this mean? Thanks to USCIS I lost a 2004 PD ...now its a 8/2006 PD.

    In the meanwhile I have a Phd offer from a top UK university and am planning to take that opportunity, even though I have an admission to a Master's here with full scholarship.
