Guys - I asked my lawyer about the predicted time frame of my case which is EB3 ROW priority date of October 2005. I asked specifically if my case would be approved in a matter of months or years. They said that my case would most likely take years!
I don't really understand how the process works - how could it be years when my priority date is only 4 months away. Does anyone have any explanation why this would be the case.
This lawyer has been great for me and I trust what they say but I am not sure about the prediction - if anyone could shed any light on this I would be so grateful.

good point about the H1 quota exempt option. Though remember there is no blanket exemption for doctors...their H1 is cap exempt only if they work for a non-profit institution/university. So it all depends on the employer.
i was in a similar situation about this with a priority date of Jan '06.. i was planning to get married in dec 2009.. but my dates were current and fearing that I might get my GC soon, I rushed to Australia (my fiancee is AUS citizen) and got a registered marriage done... she is still in aus and planning to join me later using following-to-join when i do get gc.. unfortunately, I did not get my GC when the dates were current in Aug or Sep...
but, i dont know how to advice you.. it is a very sticky situation... i think best option is to do H1B, and before that to try and get some visitor visa... my lawyer says there is a 50% chance for one to get H1B if you apply on April 1st.. and almost 0% chance if you apply after April 1st...

well this is your time. with eb3 row 2009, you probably are in wait for at least 5 years. Anyway the point is, no country would be stupid enough to stop great talent from coming through to satisfy it's diversity policy. When you are talking about 0.14 million immigrants for a nation of 300 million, that's less than 0.05%. So please take your diversity argument with you and don't let the door hit you on your way out. For this miniscule percentage, the US will lose out on thousands of the best Indian and Chinese engineering/science talent. US's loss, India/China's gain. If this is not an example of an extremely stupid strategic policy then I'm not sure what is.
Oh and by the way, may not be me or you waiting for Indian/Chinese GC's but could be your kid and mine. Let's have this talk again in a decade or two given GDP growth,debt and deficits of US and GDP growths/deficits/market size of India/China.

I think for few people this might be bad news. Some people changed their job without I-140 being approved. Sorry guys...i used AC21 but i have approved I-140.

That may be but do you actually think this practice is fair and should be legal. To me and hundreds of thousands of other folks who are patiently waiting in line, it is fraud because you are cutting in line. The sad part is we see that you are cutting in line but we can't do s**t about it just because it's legal.

Eb3I may nudge forward a little bit. Sadly that won't be very helpful to most folks on this board. Visa recapture is the only thing that can help near term. In the interim, administrative fixes, rule clarifications, USCIS efficiencies in application processings, Data transparency, though not glamorous victories as say visa recapture. Nonetheless make the path somewhat more comfortable and predictable.
EB3ROW may move also.
The movement of EB2I will be quite revealing for me. If there is quarterly spillover(which under current rules should be the case) then we might see some forward movement or at the very minimum the dates should stay put. However if there is no quarterly spillover, then with the approvals in EB2 recently, they will be hard pressed not to move dates backward somewhat.

We have been living in a county which has implemented 287g for some time. And I believe all legal residents in my county feel safer because of its implementation. Sure, there is a chance that 287g can be misused by the police. But tell me one law which can not be misused by police.
The thing is that more counties are signing on to 287g. St. Mary's County Joins Controversial Federal Immigration Initiative - Southern Maryland Headline News (http://somd.com/news/headlines/2010/11667.shtml).
I went thru the proposal in Arizona and could not find even one point which might be bad for us. Has anyone thought of the people who missed the august 17 deadline because the labor was not cleared within time. Because of no mistake from ourside, we have to suffer. What a screwed up legal situation ?
