That is true, however, from what I have heard and seen - if the GC petition is through the husband and wife stays outside for an extended period of time, generally there are no issues at the POE.
If the person through whom the petition is filed stays outside for an extended period, they might have to answer some questions at the POE.
She can stay as long as she wants, but it is finally up to the port of entry officer to decide to let her in or not depending on reason for staying outside (while 485 is pending) is valid or not. After all AP is supposed to be used only for emergency situations.

Hi,
I�m in EB2 and My I-140 was approved September 2008 through Employer A. And I got laid off on November 2009 from EMP A, within 15 days I joined another Employer B. As per policy, employer B is not going to file GC for me. Already I spend 5 years on my H1B. I check with EMP A�s HR dept, they will not revoke my I-140 and H1B. I know AC21 is one of the options to transfer (Portability) my PD to Emp B after apply I-485.
It would be great if I get answer the below my Question:
1. If my PD is current, Will I eligible to apply I-485 using Employer A I-140 approved?
2. What are the documents needed from employer A, if I want apply I-485?
3. All my friends telling me, I can apply I-485, Is it true?

Shouldn't be difficult but it is the USCIS that we are talking about after all. Unless it is passed as law, it wont happen. A dual stage I-485 application process was being discussed last year but nothing came out of it. Piecemeal legislations will not pass as the public wants CIR not bandaids.
And FYI, EAD does not eliminate employer dependency—you still need an employer.

It might not be related. My wife had a miscarriage on her 12th week. She didnt have to take the shots since we already had the records. But she did took TB skin test. I dont think they are related. We are just unlucky.

I was on H1 status but got laid off. I have my EAD and my AP has been approved but I have not yet received it in the mail. Once I do, is it safe to travel outside the US and re-enter using AP if i don't have job yet?

I can't say which is right, but I can share my information (so far). My EAD was supposedly sent Sept. 5th. On Oct. 4th when I had not received it, I called USCIS and spoke to CSR, who put in a request for a resend of the card. I still have not received it, so after 45 days (the requested wait this time) I called again today. I have another service request number now and am told to wait another 45 days... At least the CSR admited she didn't think anything was done after I called in October! I wonder how many "45 days" they want me to wait!

Hi friends
I am currently on H1B, which was recently approved under cap exempt for a non-profit employer.But, now I 'd like to work for a profit employer ,which comes under quota .So, can't I change to this new capped employer by filing a new petition at this time where there is no quota available or should my H1B be counted against cap once in the six years period to be able to change employers whether they are profit or non-profit employers? Could anybody please give me some input with all your previous experiences.Thanks in advance.

The "Time as Resident in a USCIS District" clause in the naturalization process says that "Most people must live in the USCIS District or State in which they are applying for at least 3 months before applying".
If you have gone thru this process could you please tell if this means that
a. the person must have stayed for at least 3 months during any time during of the residency period to be eligible to apply in that district
OR,
b. the person must live in the district for at least 3 months immediately preceding the naturalization application (for example, if applying in July 2010 then must be present in that state/district at least since Apr 2010)
The reason I'm asking is that I know people who live in India after GC and then come return to get citizenship...so wondering how it worked...

The image quality at high ISO numbers is also a big concern to me as well. I have found it mentioned but not much other than that. I shoot a lot of low light level photos. While I love Olympus, I also have to be aware that Olympus will be introducing at least tw new dSLR's this year that could well eclipse the E-Volt and at the least force the E-Volt prices lower.
