In the scenario #2, do I need to go out of the country and get a valid I94? (cunsular processing) before I can start work?

Fellow members,
I would appreciate anyone who could post his/her H1B stamping experience at the US Embassy in Delhi. My appointment is in the last week of March 2010.

IV,
Please start a webfax campaign in support of the Amendment S.1249, being co-sponsored by senators Maria Cantwell (D-Wash), John Cornyn (R-Tex.), Patrick Leahy (D-Vt.), Orrin Hatch (R-Pa.), and Robert Bennett (R-Utah).
There is no use just opposing the existing bill without proposing what we want actually.

If PERM is pending for over a year, then the new employer can apply for H1 extension for 1 year. This whole PERM process will have to re-started with the new employer.
Since this is a unique case, you should check with an attorney.

Not sure about what can you do by yourself in this situation would contact some immigration attorney.
More than likely you need to file Motion to reopen (and gain some time) otherwise you would end up in a one way street -however not sure about who will need to file (you or your father)? Also not sure about what would be the basis for filing such a case .
Deportation Since (I assume) you are in the US legally since 98 even if they start the deportation process probably you can file for some relief (I guess if you are here for 7 or 10 years -legally! -then in a case like that there could be some way to avoid deportation, but this would not be automatic).
I would consult with a immigration lawyer....

I came in US with my family when I was 15-16, back then we were on L2, then as time passed by we switched to H4. Then I turned 21 so I had to go on Student Visa (F1). Still living in US legally.
Now my question is I've been staying in US over 10 years now, legally. I dont know if its rumor or not, but someone told me, that you can apply for Green Card if you lived in US over 10 years legally, is that true?
Going through all that H1B process sounds really hectic. Also all my family members, friends and relatives are here, I don't know anyone back in my birthplace. any suggestions or tips, would help a bit.
thanks :)

Is there any legal issues?
Is it a good idea?
It's a BAD idea. It has been discussed for several 100 pages, and thrown out of the window by the experts and core group.
Remember couple of things:
1. Suicide attempt is illegal in the USA
2. Satyagrah is to correct any injustcie. If there are too many people applying for GC than the available number of visas then long wait is inevitable, that's not injustice.
3. Satyagrah/hunger strike is a last resort meaning only when you run out of all other option such as Legal Battle, contacting Govt/politicians etc. Did you file a law suit yet about revised July visa bulletin?

My am in eb-3 category with a PD jan 2007.
I applied my i-485 to NSC and it was transferred to NBC in 2009.
NBC arranged an interview with the local immigration office in April 2009.
The Immigration Offer issued a welcome notice even though my PD was not current.
I still have not received the GREEN CARD.
In March of 2011 I received an email saying that my case has been transferred to TSC "to speed up processing"
So I dont know if this is a good thing or a bad thing.
Please respond.
FYI: I have NOT changed my Job, my employer or my address.

I just want to confirm that this ruling is still in effect. Use AP to return as Parolee, never used EAD, can continue to work for same employer on approved H1B petition. Are there others in this situation as well?

Yes, she can come on H4 even she applied for I-485 , only if you are r still on H1B . If u or ur wife dont want to use EAD in near future then it is better to bring her on H4. otherwise coming back on H4 or AP does not make any difference.

keep in touch with me. i will try to go to local office after 90 days (ie after oct 2nd) in case i dont get EAD by then (my lawyer sent my 485 on 6.29.2007) . its just to expedite not for interim EAD. cause they dont issue interim EADs anymore.
but if you have decided to file for H1 then no point in waiting for another month.
in my case the lawyer takes too much money, even though i dont pay directly but it comes out of my salary, ultimately thats why i am not pushing for my H1 extension.
also i am hoping i will get my 140 by then so that i can get 3 yr extension.

Nebraska is the main and big center for USCIS. So, it has got more staff and more applications, more delays (sometimes). Nebraska transfers its load to TSC from time to time. Sometimes, TSC looks faster, but it is not real. It is fast because it has got fewer cases to process. When NSC sees that, then it uploads some of its load to TSC.
Not all USCIS centers are of same size and staff. NSC is the big one.

Dude, what are you talking here? Have you lost your mind?
Looks like some touts are booking dates in bulk and selling them in the black maeket. May be some of the embassy staff are colluding too. Whichever way you see it is a criminal activity.
You should be asking to expose these criminals and hand them over to police, not asking for their dubious services. Once such scums are weeded out of the system the dates will start opening up automatically.
Can someone please post the contact or privately send me the
contact of the person who helps with the dates, coz I am trying for my grandmother for quite some time but to no avail...

The only benefit of F1 over H4 is you get to use OPT and CPT. Doing an internship may be very beneficial if you are doing a MBA. After that OPT helps you to settle in a job and deal with H1B filing quota risks.
Regarding the downside of F1, many universities don't give instate tuition eligibility to students on F1. On H-4, you may pay instate tuition to many universities. So, check with the university that you are planning to attend.
Also, it will be very difficult to get a F1 visa stamp on your passport if I140 has been filed for you in the past. Its not a problem if you don't want to travel outside the country during your studies.
my 2 cents...
